Rules and Regulations

The Board has adopted the following regulations to govern this community. This is to ensure that all residents will know what is required and expected of them at all times. These rules and regulations will be enforced by any and all legal means deemed necessary per the situation, determined by the Board.

The Declaration grants this authority as follows:

“All present and future Owners, tenants, occupants, and guests of Units shall be subject to and shall comply with the provisions […of] any Rules and Regulations.”

Further, the Declaration describes in Section 25 that all penalties/fines/fees shall follow the Unit’s deed. To put it simply, the Owner is responsible. It is the Owner’s responsibility to choose how to collect and correct the issue(s) with their respective tenant(s).

For clarification, all penalties, fines, and/or fees shall be assigned to a Unit number, not just the Owner’s name. This may assist an Owner of multiple Units to know which Unit caused the issue. All fines shall have a unit number assigned for legal and accounting purposes.

I. Homeowners Fees, Legal, and Accounting Policy

Our fees are the financial basis for keeping Quail Run operating as a condominium community. These fees cover the following:

  • Garbage Collection
  • Water & Sewer Expenses
  • Lighting of the Grounds
  • Lawn Care
  • Building Maintenance 
  • Operations (insurance, Common Expenses and amenities)

These fees are due on the first day of each month. The owner of each Unit or leasing agent will receive a monthly invoice and must submit their payments to the enclosed address. The board reserves the right to impose a late charge of 1 – ½% monthly penalty (18% annually) on any outstanding fees over sixty days past due; and will continue until the account is paid in full.

The Board shall assign an Attorney who represents the interest of Quail Run Condominiums. This attorney shall use their best judgement in whether to execute liens against such Unit(s) that have late dues, assessments and/or fines imposed on the Unit(s), and furthermore may initiate foreclosure actions if the Attorney believes it is in the best interest of Quail Run Condominiums.

At the time of the adoption of these Rules and Regulations, the named attorney is Dan Christian, of Christian and Associates.

The CPA shall provide monthly reports to the entire Board, Owners upon written request and for the annual meeting. The CPA shall send 60 and 90 day delinquency reports to the Attorney each month until all units are current.

At the time of the adoption of these Rules and Regulations, the named CPA is Lonnie Shook, of Lonnie Shook CPA, PLLC.

Any Unit Owner with unpaid invoices or statements in excess of 60 days may have their privileges revoked from accessing the amenities and shall be excluded from serving on the Board until their Unit(s) are returned to a paid-in-full status.

Impact Fees

All new Owners of Quail Run after 2021 shall be subject to a $5 monthly impact fee for renting their unit. If Ownership is transferred in any means except by passing via estate (e.g. death of owner and the paperwork updates or in situations where it is clearly the same family or beneficiary of the unit) impact fees shall be collected on those tenants.

Leases have been and are subject to inspection by the Board at any time upon written request to verify the usage is in compliance with the Bylaws.

II. Amenities

The Board shall maintain a trespass agreement with Hickory Police Department to grant authorization to act as an agent of the Board.

Anyone using these amenities must be able to show some sort of proof that they or the individual they are with are a current resident of Quail Run. If they cannot provide proof, they may be asked to leave until they can show a valid identification.

All Owners and residents have a right to question anyone that they feel may be trespassing on the property. Call Hickory Police Department for assistance removing trespassers from the property.

These amenities are for the sole use of Quail Run residents and their guests. All guests must always be accompanied by the resident. Unit Owners are responsible for the actions of their tenants and their guests.

Violations of amenities rules shall be $25 fine per incident. Proof may be captured via photo with timestamps proving the incident occurrence and associated party involved.

Pool:

  • No glass containers are allowed at the pool. If found in the pool the county inspector will close the pool.
  • There is no lifeguard on duty, swim at your own risk.
  • Children under 15 years of age must be accompanied by their legal guardian. 
  • No use of the pool 30 minutes before sunset.
  • Do not leave trash.

Dock:

  • No overnight boat storage allowed.
  • There is no lifeguard on duty, swim at your own risk.

  • Do not leave trash (or fishing hooks).
  • Do not set off “sky lanterns” which may catch roofs or trees on fire.
  • Boats left moored at the dock will result in a $25 fine that will increase by $25 per day until a total of $150 per day is reached. It shall be at the discretion of the Board to when to have the boat removed.

III. Parking

There is a shortage of parking for the residents of Quail Run. Prior to re-writing these rules which defined 2 spaces per Unit going back to at least 1996, the Board has researched and counted the parking lot usage, capacity, and fluctuation to the best of its ability. It is true that currently there are fewer than 200 marked spaces. Fortunately, Quail Run has never ran out of parking. However, the distribution of spaces does not appear to be evenly spread out compared to the building placements. This is creating annoyances for residents who have to park in the visitor lot while knowing visitors are parking in spaces close to their unit for days at a time. As of 2020, there is a real and serious issue of parking capacity in several buildings while others have plenty of vacant spaces. If the vehicle count increases, all buildings could face resident parking shortages.

The Board must be proactive in addressing these issues with a Census to determine how to allocate resident parking spaces and identify resident vehicles, and identify wrongfully parked vehicles to be towed.

All vehicles should be parked responsibly and thoughtfully.

  • Do not park on the grass.
  • Do not park in front of the light poles in a corner which may impede a firetruck’s turning radius.
  • Do not park in front of the dumpsters.
  • Do not park in front of fire hydrants.
  • Do not block the path to the clubhouse.

Unit Owners may be fined $25 daily for these infractions upon proof of photo evidence showing the vehicle and tag number.

Owners shall be issued two resident parking spaces per unit.

Large trucks consuming two spaces must keep this two space limit in mind, and consider moving to the visitor parking areas to avoid the space limitations of their Unit.

Visitor Lot Rules – New 2021

Excess vehicles shall be parked in the visitor parking areas. Please advise your guests to park in the visitor parking areas. Violators may be towed at the vehicle owner’s expense.

The Board shall use its best judgement to designate visitor parking areas as data arrives from the Census. Currently, the visitor parking areas are defined as the parking lot in front of the mailboxes, and the angled spaces immediately across.

Any abandoned vehicles, or vehicles without a valid license plate not reported to the HOA may be towed 7 days after a courtesy notice has been placed on the vehicle. The courtesy notice is not required for towing and is up to the judgement of the Board.

All boats and trailers are to be parked in the visitor lot near the mailboxes, and must be registered with the HOA. The HOA must comply with City of Hickory ordinances regarding junk and abandoned vehicles, and even debris sitting in open trailers. You may read the City of Hickory’s Code and Definitions: Code 1981, 18-59 Amend No 4-4-95.

The City of Hickory considers Quail Run responsible for these parking lot contents, not the vehicle owners. Therefore, the Board has the right to utilize Section 8 of the Bylaws, “Powers and Duties” for the Board of Directors. The Board has the authority to remove any and all property on the grounds to prevent fines against Quail Run.

No class A or B commercial vehicles are allowed to park or be stored in the parking lot or any common areas, except for the purpose of loading/unloading personal property.

The sanitation truck comes during the early morning hours and cannot empty the dumpsters if they are blocked. By law, the fire hydrants must be accessible. Vehicles parked in these areas may be towed.

Boats shall not be parked in the clubhouse parking lot. There is limited parking at the clubhouse. All boats are to be parked in the visitor lot and registered with the HOA. The Board may remove these boats at the Unit Owner’s expense.

To begin enforcing these Rules, notices will be placed on vehicles in the weeks following adoption of these Rules before immediate actions are taken so residents have time to adjust and take action before September 15, 2020.

Reasonable Leniency

To reiterate, to the date of these enacted Rules, Quail Run has never ran out of parking. The Board does not want to negatively impact situations such as holidays, where many of our residents may be out of town, and more guests may be parking at Quail Run. During these specific situations, the Board will use its best judgement to be reasonably lenient on those parking situations.

IV. Grounds & Cleanliness

All Owners and residents are welcome to plant flowers in the central common areas at their entrance, but will be responsible for their care. If neglected or unsightly, the Board can remove it. Anyone wishing to plant shrubbery or other large plants must submit their intent, in writing, with name, unit number, and phone number before planting for the Board’s approval. The President will give a response within two weeks of the decision and can notify the landscaping crew accordingly.

No exterior fixtures, antennas, large satellite dishes, or clothes lines shall be installed on Quail Run Property. It will be removed at the Unit Owner’s expense.

No grills or appliances shall be allowed on rear decks as it is a dangerous fire hazard.

Any fixtures to help a handicapped individual may be installed at individual entrances at the owners or tenant’s expense; but are to be removed and the grounds returned to original condition if said person(s) moves or suffers any other demise.

Littering will not be tolerated. Proof may be obtained via photo or video evidence. The Unit Owner will be fined $25 per day until it is corrected by the Owner, their tenants, occupants, or guests.

No trash or furniture is to be placed in front of, or on top of the dumpsters. The Unit Owner will be fined $25 per day until it is corrected by the Owner, their tenants, occupants, or guests.

Each resident is responsible for the disposal of appliances and other large items by contacting the City of Hickory Sanitation Department for removal of such. Do not place these items in/or in front of the dumpsters. The collection truck will not empty dumpsters containing such items and then the Board will have to pay an extra fee for them to come and dump the dumpster on another day. Typically, these items are to only be placed by the road. Do not place this on any other section of Quail Run’s property.

Once a total of $150 per day (6 days from first fine) has been reached, the Board will have the right to call the Hickory Police Department. The Unit Owner will continue to be charged $150 per day until the property has been corrected.

Dismantling or major overhauls of vehicles or parts thereof is not allowed in the parking area or on the common grounds of this complex. Anyone dismantling or performing major overhauls on a vehicle will be subject to removal of such vehicle at owner’s expense.

V. Visual Compliance & Upgrades

The Board understands the need and desire for individual units to have a unique appearance. This helps prevent the cookie-cutter “which unit is mine?” issue that some condominiums encounter. However, we have a responsibility to keep our esthetics within due bounds and set the minimum standards of appearance.

Structural Modifications – 2021 Update

Windows

Any windows that have become cloudy due to seal leakage between the panes of glass must be replaced with Board-approved white vinyl windows.

The Board will be inspecting all front windows within the first 6 months of 2021. The rear windows will be inspected in the first 6 months of 2022. If the Board deems that a Unit’s windows need to be replaced, the Unit Owner will be responsible for having the new windows professionally installed to insure the integrity of the building structure during that inspection year.

Owners must notify the HOA board to inspect the new replacement purchase before it is installed to prevent any issues. 

If the Owner fails to comply, the Owner will be fined $50 monthly until the replacement is completed.

The Owner is responsible for having the old windows hauled away from the Quail Run property. They are not to be left at the dumpster or at the road. If the Board finds that the old windows have been left on the property, the Owner will be subject to a fine of $100.

Blinds

All front-facing or side-facing windows need to be uniform to create a pleasing esthetic for the complex. All of these front-facing and side-facing defined windows must use 2″ horizontal blinds, no exceptions, by the end of 2020.

All blinds must be maintained at all times. Broken blinds will not be allowed and must be replaced within 60 days of written notice from the Board before the Owner incurs fines of $20 a month. Please keep in mind some windows are special sizes and may take up to a week to arrive.

Please keep in mind before you order, that if you own multiple Units, the window sizes are not always the same. Certain manufacturers of blinds may offer the option of no strings, but not necessarily in the tallest size required for the front door window. Certain brands may offer flat or grain imprints on the blades. These options are entirely your choice. As long as the blinds are white and 2″, the Board will not mind your selection.

Patio door coverings can be vertical, drapes with white linings, or no coverings at all.

Patio Door Awnings & Covers

With fewer trees on parts of the property, the lake view has improved in some units. However, many of those units are experiencing the heat of the sun like never before. Due to this lack of shade, the Board will allow awnings to be installed upon consultation.

Owners must submit the awnings or covers to the Board for approval. If approved, the awning must be professionally installed to insure the integrity of the structure is not damaged. Once the installation is complete the Board can designate the deck complete.

Front Doors

The front door must be clean and free of any dirt, peeling paint, and damage. If the Board inspects and identifies an issue, the Owner will be notified in writing to correct the issue within 180 days (6 months). If the Owner fails to comply, the Owner will be fined $20 a month until the issues are corrected.

The front door is important to create a warm, inviting, and welcoming atmosphere for each residence. The front door is the best way to personalize a unit. Therefore, we are expanding the allowed colors from just the white and blue doors to the following colors which will match Quail Run’s branding in the future:

The Owner must make sure it is the exact match to the proposed colors. The Owner should have the paint applied professionally.

If the Board determines the Owner must replace a front door, or if the Owner chooses to replace their existing front door, the Owner must obtain the Board’s approval for the style of the door.

Storm Doors

The HOA proposes that all storm doors must be full-view, in either white or black as shown below. No exceptions.

If the Board inspects and identifies an issue, the Owner will be notified in writing to correct the issue by April 15, 2021. If the Owner fails to comply, the Owner will be fined $20 a month until the issue is corrected.

Storm door inspections shall begin in the following weeks of the 2020 Rules adoption, to ensure all Units are compliant by April 15, 2021.

VI. Nuisances

Noise

Please be considerate of your neighbors by playing any music, televisions, or other audio equipment at a respectable level. Sound travel flows through adjacent walls, floors, ceilings and decks. The City of Hickory has noise nuisance laws that prohibit any noise that disturb neighbors after 11:00PM. All excessively loud music and/or other outdoor activities should halt at this time.

Any disruptions after 11:00 PM are to be reported to the Hickory Police Department as this will fall into their statutes and authority. Please see Chapter 19 of the municipal code for further definitions. Plaintiffs must personally contact HPD for their assistance in this matter.

Toys and Equipment

Bicycles, skateboards, or other wheeled toys/sports equipment are not allowed to be stored on sidewalks or entrance areas to units. Parents are responsible for the actions of their children and shall provide supervision of them as necessary. Leaving toys or any items in the common areas for more than 1 day will be removed and possibly trashed. Removal of such items is at the discretion of the Board.

Pets

Please be aware Quail Run is within city limits of Hickory. All cats and dogs are subject to leash laws. Per City ordinance, Chapter 4, Article 3, up to 5 small domestic animals are permitted to be kept.

Be considerate of your neighbors by observing the following: 

  • Do not let your pets destroy areas by digging.
  • Always control your pet on a leash as required by the City of Hickory.
  • Do not allow the pet to leave the confines of your unit without a leash. The Owner may be subject to fines for “losing their pet” every time it needs to defecate.
  • Do not leave pets tied or chained up outside unattended.
  • Pick up after a pet defecates within 10 minutes. The penalty for violation will be a $50 fine per violation. Complaints may be logged via photo/video of offense taking place or by witness account of 2 unrelated residents. 
  • Avoid situations in which a pet will disturb others. E.G., if the pet barks non-stop while you are not home, that is an annoyance. Please find a way to control this, be it leaving the window up or leaving a television on. Complaints may be logged via photo/video of offense taking place or by witness account of 2 unrelated residents. 

All pets allowed to roam will be subject to collection by animal control personnel, as the City of Hickory policy.

No animals, other than those recognized by the City of Hickory ordinances, can be owned, boarded, or kept in any manner on or about Quail Run properties.

In order to report violators, residents must have photo or video proof of the issue. The Board shall allow a 10 minute removal time in case the resident does not have a baggie on them (surprises) or in thunderstorms, but should be cleaned up as soon as the weather clears. The Board asks everyone to be reasonable about this. With new Dog Waste Stations, there should be no legitimate excuse for leaving animal waste behind.

VII. Maximum Fine

Repeat offenders of Quail Run Rules and Regulations may have fines of larger value levied upon them, at the Board’s discretion, not to exceed $150 per day per incident.

VIII. Decks & Walkways Explained

According to the Bylaws, and according to every President dating back to at least 1996, the Board has understood the role of the HOA’s involvement in structural issues to be defined as follows:

The supporting “beams” of rear decks are the responsibility of the HOA. It is difficult if not impossible for the HOA to inspect these structures. The boards going across these beams are the Owner’s responsibility to paint and maintain. Similar to the walls inside a Unit, you can paint or choose to use composite boards or whatever you wish as long as it is properly within the color approved by the Board.

Decks are NOT ALLOWED to have any coverings, rugs, carpet, etc. on them. If it needs painted, paint it, or stain it in compliance with the color allowed. These coverings are known to create leaks in the walls below. Water must be able to flow.

The decks should have flashing attached underneath, which is typically visible looking at the patio door straight down. Please check once a year to make sure the boards closest to the door (¼ inch spacing) are clean of debris (leaves, sticks, dirt) to help make sure the rain flows properly and doesn’t damage the Unit below.

Walkways are and have been the responsibility of the HOA. Owners are allowed to paint or stain the walkways by the Board, with written permission from the Board if they desire to do so in-between regular paintings of the Quail Run grounds.
